Terms of Service

These Terms of Service (“Terms”) govern your use of the website at laauhouse.com (the “Site”) and your inquiry, booking, or stay at the La'au Paina beachfront estate in Mokuleia, Hawaii (the “Property”). The Site and the Property are operated by the owner of the Property (“we,” “us,” or “Owner”). By using the Site or booking the Property, you (“Guest”) agree to these Terms.

1. Inquiries and Bookings

Listings, photographs, descriptions, and rates on the Site are provided for general information and may change without notice. No booking is confirmed until (a) you receive written confirmation from us, (b) you have signed the applicable Rental Agreement, and (c) the required payment has been received and cleared. Submitting an inquiry through the Site does not reserve dates or create a contract.

2. Eligibility and Authority

You represent that you are at least 25 years old, that the information you provide is accurate, and that you are authorized to bind every member of your traveling party to these Terms, the Rental Agreement, and the House Rules.

3. Compliance with Local Law

We operate the Property in compliance with the applicable laws of the State of Hawaii and the City and County of Honolulu, including registration, tax, and short-term-rental regulations. Where local ordinances govern minimum rental terms for the Property’s zoning, those minimums are followed and reflected in the Rental Agreement. Hawaii Transient Accommodations Tax (TAT) and General Excise Tax (GET) are collected and remitted as required by law.

4. Rates, Taxes, and Fees

Quoted rates apply only to the specific dates, occupancy, and home(s) identified in a written quote. Rates may include nightly charges, cleaning fees, applicable taxes, and any optional services you request. Taxes and fees are itemized in your quote and Rental Agreement.

5. Use of the Site

You agree not to:

  • Use the Site for any unlawful purpose;
  • Attempt to gain unauthorized access to the Site, our systems, or other users’ information;
  • Copy, modify, distribute, or create derivative works from the Site or its content without our written permission; or
  • Use any automated means to scrape, harvest, or interfere with the Site.

6. Intellectual Property

All content on the Site (including photographs, text, logos, and design) is owned by or licensed to us and is protected by copyright, trademark, and other laws. You receive no license except the right to view the Site for personal, non-commercial purposes.

7. Disclaimers

The Site and the Property are provided “as is.” To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. The Property is a beachfront home with natural ocean exposure; salt air, surf conditions, marine life, weather, and wildlife are part of the setting and outside our control.

8. Limitation of Liability

To the fullest extent permitted by law, we, our owners, agents, managers, and employees shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Site, your stay at the Property, or any acts of nature, weather events, ocean conditions, utility interruptions, or third-party services. Our aggregate liability for any claim arising out of these Terms, the Rental Agreement, or your stay shall not exceed the total amount you paid for the applicable booking.

9. Indemnification

You agree to defend, indemnify, and hold harmless the Owner, the Property’s management company, and their respective owners, officers, employees, and agents from and against any and all claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from (a) your or your guests’ use of the Site or the Property, (b) any breach of these Terms, the Rental Agreement, or the House Rules, or (c) any negligent or wrongful act or omission by you or any member of your traveling party.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms, the Rental Agreement, or your stay shall be resolved exclusively in the state or federal courts located in Honolulu, Hawaii, and you consent to the personal jurisdiction of those courts.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site or the Property after changes are posted constitutes acceptance of the updated Terms. The Terms in effect at the time of your booking govern that booking.
